My 2 months old Sony ExperiaU phone is giving me a nightmare. The phone keeps automatically switching off and on - about 2-3 times a minute. Neither can I make calls nor access any apps...I want to upgrade the phone but the dealer told me that I can do so only after 1.5years..Why am I being penalised for a poor phone? Why does Fido not allow me to upgrade my phone?

I am sorry to hear about this.
Since your phone is only 2 months old, you are still under the manufacturers 1 year warranty, therefore you can bring it to a participating store to have it repaired or exchanged if it is deemed defective. If they exchange it, it would be for the same model phone. You can find the closest stores here.
Lastly, we are not penalizing you in the least. We simply cannot justify giving you another phone just 2 months into your current 2 year agreement and absord the costs. You may buy out your agreement in order to upgrade to a new phone now at the agreement cost, or you may purchase a new phone at full price.
