When am i eligible for a phone upgrade?

im on the 2nd year of my 3 year term and i dont know when ill be able to upgrade, i emailed fido about 2 days ago and no response yet

You can upgrade whenever you want. I guess what you are asking is when can you upgrade without any penalty fees for breaking contract. That would be 1 month before the term ends.
